Terms of Service.

By using madtuner.com's and its Owner - Ion Soltan's (the “Seller”) Services, Products, Website and its Content, you (the “Customer”) agree to be bound by the following terms and conditions (the "Terms of Service").

Limitation of Liability.

To the fullest extent permitted by law, the Customer waives and relinquishes any claims, demands, causes of action or recoveries for punitive damages, exemplary damages, or statutory damages. In no event will the Seller be liable for indirect, special, incidental or consequential damages arising under these Terms of Service or otherwise with respect to the sale of the Products or provision of Services, including any lost revenues or profits, consequential and/or incidental damages, business interruption or damage to business reputation, regardless of the theory upon which any claim may be based, including any tort or statutory causes of action. Notwithstanding the terms of any limited warranty, and/or in the event any limited warranty provided to Customer fails of its essential purpose, in no event will Seller’s entire liability to Customer exceed the purchase price actually paid by Customer for the Products and/or Services subject to the contract or agreement in dispute, or any defective or nonconforming portion thereof, whichever is the lesser amount.

Some states or other jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitations and exclusions may not apply in such case.

Limited Warranty.

The Customer understands and agrees that Services and Products offered by the Seller are intended for competition use only and as such, are provided “AS-IS”, with no implied or expressed warranty of any kind.

The Customer understands and agrees that the use of information on this Website, its Services or its Products is at his or hers sole risk and responsibility.

Copyright.

All of the information, Content, Services and software displayed on, transmitted through, or used in connection with madtuner.com, including for example calibration or programming files, programming software, reviews, text, data, and the like (collectively, the “Content”) is owned by madtuner.com and its Owner.

You may use the Content solely for your personal, non-commercial use, and you may download or print a single copy of any portion of the Content for your personal, non-commercial use. You may not, for example, republish the Content on any Internet, Intranet or Extranet site or incorporate the Content in any database, compilation, archive or cache. You may not distribute any of the Content to others, whether or not for payment or other consideration, and you may not reproduce, share, sell, publish, transmit, display or otherwise use any portion of the Content without the written consent of madtuner.com.

Requests regarding use of the Content for any purpose other than personal, noncommercial use should be directed ion@madtuner.com.

Failure to comply with these terms may result in termination of future services and support by the Seller to the Customer.

Miscellaneous Provisions.

The Content of this Website and of these "Terms of Service" are subject to change without prior notice.

These Terms of Service will be governed by and construed in accordance with the laws of the State of Illinois, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.
